By accessing or using HeyKeywords ("the Service"), operated by HeyTony, you agree to be bound by these Terms of Use. If you do not agree to these terms, please do not use the Service. We reserve the right to modify these terms at any time, and your continued use of the Service constitutes acceptance of any changes.

2. Description of Service

HeyKeywords provides keyword research tools, domain analysis, keyword gap analysis, and backlink gap analysis services. The Service is provided "as is" and we make no warranties regarding the accuracy, reliability, or completeness of the data provided.

3. Data Disclaimer

Important: All data provided by this Service, including but not limited to search volumes, keyword difficulty scores, traffic estimates, and competition metrics, are estimates only. This data is derived from third-party sources and proprietary algorithms. We do not guarantee the accuracy of any data or any specific ranking results from using this information. Search engine algorithms change frequently, and actual results may vary significantly from estimates provided.

4. No Guarantee of Results

We explicitly disclaim any guarantee of results from using our Service. SEO success depends on numerous factors beyond keyword selection, including but not limited to: content quality, website technical performance, backlink profile, domain authority, user experience, and search engine algorithm changes. Using our keyword data does not guarantee improved rankings, traffic, or business outcomes.

5. User Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. You agree to notify us immediately of any unauthorized use of your account. We reserve the right to suspend or terminate accounts that violate these terms or engage in fraudulent activity.

6. Acceptable Use

You agree not to:

Use the Service for any unlawful purpose
Attempt to gain unauthorized access to the Service or its systems
Use automated tools to scrape or extract data beyond normal usage patterns
Resell or redistribute the data without permission
Interfere with the proper functioning of the Service
Circumvent usage limits or restrictions

7. Intellectual Property

The Service, including its design, features, and content, is owned by HeyTony and protected by intellectual property laws. You may not copy, modify, or distribute the Service or any part thereof without express written permission.

8. Payment and Refunds

Paid subscriptions are billed in advance on a monthly basis. You may cancel at any time, and your subscription will remain active until the end of the current billing period. We do not offer refunds for partial months or unused features.

9. Limitation of Liability

To the maximum extent permitted by law, HeyTony shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising from your use of the Service. Our total liability shall not exceed the amount you paid for the Service in the twelve months preceding the claim.

10. Indemnification

You agree to indemnify and hold harmless HeyTony, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the Service or violation of these terms.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Province of Ontario, Canada, without regard to its conflict of law provisions.
